ABSTRACT

Landlord and tenant relationship is a common everything phase describing the legal relation existing between the lessor and lessees of that estate which is created whenever one person ( lessor) vests on another person (lessee) the right to exclusive possession and use of a given real property for a duration certain or capable of ascertain ability. This study is aimed at determine the causes of conflicts in landlord and tenant relationships and resolution of the conflict with a view to proffering more dynamic landlord and tenant conflict resolution strategies.

In landlord and tenant relationship, conflict can prevent landlord from earning a fair returns on his rent accruing from the property just as the desire of the tenant to derive maximum utility from his occupation will suffer defeat.

To aid carrying out this study, two types of data will be applied. These are based on primary and secondary source of data collection.

 

CHAPTER ONE

        INTRODUCTION

  • BACKGROUND OF STDUY

The objectives of landlord and tenant relationships is to enable the landlord look after and maintain his property in order to keep at-float in the property market in order to gain optimal returns from the property while tenants, on the order hand, want the best value for the rent paid and all the services stipulated during lease negotiations.

Hence lease is both a contract and a conveyance it sets forth the terms of the agreement between the parties (landlord and tenant).it enables the landlord regulate tenant occupation while enabling tenant known precisely his right and obligations for his occupation.

The history of landlord and tenant relationship socio-economically and legally, dates back to creation when the first landlord the lord God, leased his property the Garden of Eden to the tenant Adam to “dress it  and to keep it, and to freely eat of every tree of the Garden” while the tenant like manner and without denying or tampering with the landlords reversionary interest, the breach of which was epitomized by eating of the tree of the knowledge of good and evil Gen(2 : 15-4).

The social and economic contributions of landlord relationship recommend the relationship for proper attention and protection to ensure cordiality in its operations.

This research was informed by the personal desire of the researcher to find solution to the problems besetting the relationship with a view to ensuring its peaceful and beneficial existence since that forms the bedrock of successful property management.

1.1 STATEMENT OF RESEARCH   PROBLEMS

An essential ingredient in the achievement of the objective of landlord and tenant in entering into contract is cordial relationship although the interest of the parties are not mutually exclusive, conflict in the relationship can prevent landlord from earning a fair returns on his investment in the property just as the desire of the tenant to derive maximum utility from occupation will also suffer defeat, the society will be worse of it.

Therefore, to give opportunity to all ranks of interests associate with the particular property to be exercised without friction the lease sets out rights and obligations for both landlord and tenant.

Today neither the landlord nor the tenant meets his obligations under the lease because with the steady fall in the real value of his income the tenant finds it difficult to pay his rent promptly or sufficiently of utility bills. The landlord still wants to derive maximum utility from his temporary occupation. The obvious consequence is conflict in relationship between landlord and tenant, and the objective of the relationship will hardly be realized in the presence of conflict.

1.2   AIM AND OBJECTIVES

The main aim of this study is to proffer resolution of conflict which has being in existence between landlord and tenant relationship.

The following objectives will be adopted to achieve the aim:

  • To ascertain causes of conflict in landlord and tenant relationship.
  • Identify methods adopted in resolution of these conflicts
  • Assess method adopted in resolution of the conflict
  • Identify and recommend ways of improving resolution of conflicts in landlord and tenant relationship.

1.3   RESEARCH QUESTIONS

Against the above background, this study was undertaking to address the following research question:

1 what constitute a landlord and tenant?

2 what are the causes of conflict in landlord and tenant relationship?

3 what are the consequence of conflict between a landlord and tenant?

4 what are the method to be adopted in  conflict resolution

5 what are the benefits of conflict resolution in landlord and tenant relationship.

1.4 JUSTIFICATION OF STUDY

This study will be of immense assistance to both landlord and tenant in maintaining a cordial relationship for peaceful co-existence and also to the estate surveyor and valuers in clear understanding of lease terms and enforcement of leases on both the landlord and tenant from the initial stage to the conclusion of the lease agreement to avert conflicts.

STUDY AREA

According to Oni (2009) Lagos is the largest city in Nigeria with the estimates of its population varying considerably but generally range from 10 to 15.5 million people. It is the second largest city in Africa located at 6(degrees) 34’ 60”N, 3(Degrees) 19’ 59”E along the West Africa coast. It is the former capital city of Nigeria replaced by Abuja on 12th December 1991 but remains the commercial centre of Nigeria the city of Lagos is expected to hit 24.5 million population marks and thus be among ten most populous cities in the world by the year 2015.

The Lagos metropolitan area spreads over much of Lagos state, which itself covers an area approximately 3,345 square kilometres. It is located on four principal islands and adjacent parts of mainland by bridges and landfills, with major sections of the metropolis that include the old city serving as the commercial district on western Lagos island Ikoyi island is situated east of Lagos island and joined to it by a landfill, while Apapa is the chief port district located on the mainland- other components of the metropolis are Victoria island, industrialised Iddo island consisting of mainland suburbs, Ebute meta, Yaba, Surulere, Ajegunle, Shomolu, Agege, Mushin and Ikeja (Oni, 2008).

Research of this study is carried out only on landlord and tenant of developed properties occupied for residence and commercial that are being managed by Estate surveyors and Valuers in Lagos metropolis were investigated.

1.1     BACKGROUND OF THE STUDY

Industrial relation has become formalized in the form of  employment contract between the workers and the employers. The parties are seen as equal, who have invested their capital and aim at maximizing profit. The workers on the other hand contribute his  services, which if not remunerated falls into abject poverty and dies.

 

An industrial or labour management relation is a strategic aspect of human resources management and can be defined in several ways.

 

Anugwom (20020 defines industrial relation:

As the network of social relationship between the employees and their union, employers and the association, and the government and the numerous agencies in their attempts to regulate terms and conditions of employment and person other function that directly concern the initiation and substance of peaceful and purposeful labour management relation which involve applying machinery dealing with complaint, grievance and disputes in an organization.

 

Yesufu (1984) defined “Industrial Relations as a whole web of human interactions at work which is predicated upon the matters that arise out of the employment contract”.

 

Armstrong (1980) sees Industrial Relation as the intertwining activities of the worker, managing and government for better working conditions.

 

Hence, the scope of industrial relations embraces relations and interaction between one trade union management and the state (i.e.  government) are all important issues which fall with in the purview of industrial relations.

 

In the federal ministry of finance, Abuja, industrial relation deals with everything that affects the relationship between workers and employers, perhaps from the time the employee joins the work in federal ministry of financial until the time he or she leaves his or her job.

 

However, industrial relation is also fundamentally concerned with a complexity of power relationship and power sharing between management, the employee or trade union and the state (i.e. government) furthermore, with the realization of the vital importance of work to the entire life of a worker, industrial relations is becoming increasingly concerned with how the employee can be fully identified with the purpose of the organization and how he, by effective participation both in the work effort and decision making, can find greater self fulfillment in the work situation (Yesufu 1984).

 

 

1.2     STATEMENT OF THE PROBLEM

The attention have been devoted to examine the cause or factors which have been largely responsible for unproductively in the industrial relation practice.

One of the problems of industrial relation practice is employment of unsuitable candidates in preference to candidates of high merit. The reason can be trace directly to nepotism. Another problem encountered is the area of employment security whereby there is unusual termination of employment.

ABSTRACT

The purpose of this study is to identify interpret and understand the effect of early marriage on the academic performance of the girl-child with a view to recommending appropriate measure to be taken in order to enhance their welfare in terms of education and thus empower them to become relevant and potential citizens of the contemporary Nigeria. The investigation was conducted solely with the purpose of findings out the attitude of the general public on early marriage of girl-child, the effect of government as per discouraging the practice, the effect of the practice on the nation’s political and economical terrains. The following recommendations were made in this research work, the government should ensure that their programmes on orientation should be properly channeled in order to get to the grassroots, government should introduce on the school curriculum topics on early marriage and its effects on Nigeria child.

CHAPTER ONE

INTRODUCTION

BACKGROUND OF THE STUDY

       Right from the beginning of ages, the effect of early marriage on the academic performance of the girl child has been a topic for debate. In 2004, Children’s national Day, the UNICEF in collaboration with the Ministry of Education in Nigeria, had a presentation of statistical result of schooling children to non-schooling children in the contemporary society. the research presentation shows that over 7.2 million Nigerian children are out of school as they engaged themselves in hawking, as maid to people or otherwise. Meanwhile, from the above result, 87% of these children found outside school were girls. In a press briefing organized by the Chairman of National Orientation Agency, Dr. Chukwuemeka Chukwudi the major reasons why more girl child are found outside school was because female children are given out on marriage at an early age range.

       It is no longer a matter of argument that females constitute more than fifty percent (50%) of worlds active population (UNESCO, 2008). Although they make immense contribution to national development, they still face a number of difficulties that limit their potentials in promoting personal and collective development. A key area of concern in this regard is that of their education, which can only at best be described as dwindling as and less than equal to that of the male. (Obaya, 2003). The marriage institution is very vital in any society; it’s legitimate in the productive process and ensures the meaningful preparation of the social norm of society. Yet the timing and the resultant impact of early marriage is a source of concern for many who cherish the equitable participation of female in modern education. When girls are married at age of 10 to 14, their educational careers are disrupted especially if an avenue for second chance learning is not provided. Once girls are left behind in this process, they add to the burden of development of the society and their positive roles and contributions are limited early.

       It is impossible to allow girls to marry at the ages of maturity, when they must have had opportunities for the attainment of basic education. meanwhile, one understand that the idea of girls being giving out to men for marriage at an early stage of life is not really because their parents, long for such life, but simply because of the poverty level of families. The indicator of prevailing poverty among the poor, rural and urban populace that the world receives from the UNDP annually is a clear evidence of lack of equitable distribution of wealth in society. As a result, several families live below the poverty line, living on less than N50 per day. We know for a fact that most of the families in Africa are extended, especially, with devastating impact of diseases including malnutrition, and HIV/AIDS. Consequently, families are less able to cater for the educational needs of their wards. When choices are made on who goes to school, the males are given preferential treatment, thereby leaving the girl child largely not catered for. This means that poverty’s impact on child education is felt more by the girl child, as most girls are giving out in marriage on a reason of getting money from the son in-law to sponsor the male child’s education. The question is: why must this be the case. Apart from the fact that parents do give this girl child out on marriage early, thus impeding their chances of education, it is observed likewise that, there are instances where the females themselves bear n themselves poor self concepts of being unable to cope with challenges of modern impressions society placed on them. This then becomes a very serious impediments to their learning and educational pursuits. There is a populate belief in society that modern education only emphasizes instrumental goals, that is, that it is mainly employment oriented. Therefore when learners complete educational programmes without commensurate assurance for modern sector jobs, society sees a mismatch and lack of energy. This discourages participation, given that no serious meaning is ever attached to learning itself. Similarly, schools do not teach skills that may help learners to become self reliant and gain self employment from their formal training.

Moreover, the female child sometimes agree to their parental ideas as regard getting married at a very early stage of life, tentatively because or the knowledge they have acquired that all perspective of education is masculine in nature.

STATEMENT OF PROBLEMS     

       This study is specifically concerned with many and varied problems of the handicapped in Benin City, the handicaps here are referred to females whom are giving out to marriage at a very early age, this considering how this is affecting their education. the problems are in the following areas:

a.          What is early marriage?

b.          What are the causes of early marriage?

c.           How does the early marriage affect female education?

d.          What is the government doing to stop early marriage?

e.          What is the general attitude towards early marriage?

f.            In what area can we find higher rate of early marriage?

g.          What percentage of females get a second chance for education alter early marriage and otherwise.

SIGNIFICANCE OF STUDY  

       It is expected that findings from this study will help in the following areas:

1.          Help to identify what early marriage is all about.

2.          Enumerate the causes of early marriage

3.          Identify the effect of early marriage on the academic performance on girl child.

4.          Identify government aid towards the stopping of early marriage in Nigeria.

5.          To know the general attitude of the public towards early marriage.

6.          Should be able to tell if early marriage is higher in the rural areas or in the urban area.

7.          Identify the percentage of those that get a second chance for education after early marriage and the percentage of those that do not get second chance for education after early marriage.

PURPOSE OF THE STUDY  

       Early marriages have been found to be at a very high rate in Asian, Africa Continents, even Latin America. The research work done by WOTCLEE, UNICEF and the ministry of education revealed that the future of Nigeria is being endangered as more than 50% Nigerians active population are derived of education as they are given out for marriage at a very early age. Meanwhile, the purpose of this research is to look at the situation of early marriage, its effect on academic performance of the girl child and then proffering avenues to reduce to the barest minimum, the idea of early marriage in our society.

SCOPE OR DELIMITATION    

       This study will be limited to selected age groups viz: victims of early marriage, students and teachers in Oredo Local Government Area in Edo State. Samples will be gathered from the following:

–              New Era College,

–              Garick Memorial Secondary School, 

–              Oba Market,

–              Some selected full time housewife, etc
